You are advised to read these terms and conditions of use carefully before using this site. Your use of this site is expressly conditioned on your acceptance of the following terms and conditions and any other law or regulation that applies to the site. By using this site and registering with us, you agree to be bound by the following terms and conditions. If you do not agree with any part of the following terms and conditions, please do not use this site. Terms and conditions may be revised at any time by updating this posting.

1. OWNERSHIP

a. All materials used and displayed on this site, including but not limited to text, software, graphics, icons, illustrations, artwork, names, logos, trademarks and service marks are the property of Green Trail Tours  and its licensees and licensors, and are protected by trademark and other laws.

b. You are not permitted to modify, reproduce, republish, disseminate, distribute, sell, transfer, or modify any part of this site without the permission of Green Trail Tours  and/or its licensees and licensors.

2. UNDERTAKINGS

a. You represent that you are of sufficient legal age to enter into this agreement and use this site in accordance with all the terms and conditions herein. You understand that you are financially responsible for all uses of this site by you and those using your login information.

b. You are responsible for maintaining the confidentiality of the account and password and fully responsible for all bookings and activities occurred under your account or password. You shall immediately notify Green Trail Tours of any unauthorised use of your account or password or any other breach of security. You are advised to change your password regularly as a precaution.

c. You must provide full and accurate information (including but not limited to names, passport numbers, age gender, occupation, addresses, telephone numbers and e-mail addresses) when accessing this site and/or when making any online travel reservations.

d. You are to honor your online reservations made through this site and remit to Green Trail Tours all charges for all services and products booked; payment terms will be by credit card. You are also liable for any surcharges, cancellation of bookings, unauthorised bookings made by yourself or on behalf of unregistered person (s).

e. You must pay in full for all online reservations for any travel service or product prior to consumption.

f. You agree to use this site to make legitimate reservations or purchases for you or for another person for whom you are legally authorised to act. You are prohibited to use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand.

g. You are not to copy, reproduce, republish, upload, download, store, sell, post, transmit, broadcast, circulate, distribute, display, create derivate works from or in any way exploit the content of this site without the permission of Green Trail Tours . You are permitted to print extracts of the materials presented on this site on a single computer for your personal, non-commercial use only.

h. Unauthorised use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property, laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials. The use of such materials on any other web site or in any environment of networked computers is prohibited. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.

3. DISCLAIMER AND LIMITATIONS

a. All products and/or services offered for sale and/or reservation on this site are subject to availability; acceptance, confirmation, denial, cancellation and/or postponement of such product and/or service is solely at the discretion of the product supplier. Green Trail  Tours shall not be  liable for any claims against overbooking, misinformation or mishandling of reservations by suppliers, and/or any other dissatisfaction or complaint relating to the quality of the products and/or services provided by the supplier or otherwise howsoever. In the event of mishandling, misinformation or overbooking by a supplier, or any dissatisfaction or complaint aforesaid, you should take up the matter directly with the supplier who are under an obligation to deal with such matters in accordance with Green Trail Tours  policies.

b. Green Trail  Tours  has taken all reasonable steps to ensure that this site is error free and virus free. However, Green Trail Tours does not warrant and cannot warrant that the use of this site will be uninterrupted, error free or virus free.

c. Save for Green Trail Tours  's willful default and gross negligence, Green Trail Tours  shall not be liable for any injury, loss, claim, damage of any kind (including but not limited to lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which  arises out of or is in any way connected with any use of this site or content found herein, any failure or delay (including but not limited to the use of or inability to use any component of this site for reservations), or the performance or non-performance by Green Trail Tours  or any third party suppliers, even if such party has been advised of the possibility of such damages, or for any other party. If, notwithstanding the foregoing, Green Trail Tours  should be  liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or use of this site or its content, the liability of Green Trail Tours  shall in no event exceed, in aggregate, the total price of the reservation (s) with respect to which liability is found. In its sole discretion, in addition to any other rights or remedies available to Green Trail Tours and without any liability whatsoever, Green Trail Tours at any time and without notice may terminate or restrict your access to any component of this site.

d. Green Trail Tours shall not be liable for failures or delays in performing its obligations arising from any cause beyond its control, including but not limited to acts of God, acts of civil or military authority, fires, strikes, lockouts or labour disputes, epidemics, governmental restrictions, wars, riots. Green Trail Tours shall not be liable for any delay in performing or failure to perform obligations if the delay or failure results from such events or circumstances outside its reasonable control. Such delay or failure shall not constitute a breach on the part of Green Trail  Tours .

4. INDEMNITIES
You shall defend and indemnify Green Trail Tours from and against all claims, demands, actions, proceedings, damages, liabilities, loss, expenses (including legal costs on a solicitor and client basis) which may be made against or suffered or incurred by Green Trail  Tours arising directly or indirectly from your use of this site, whether authorised or not authorised by you, with or without your knowledge; and/or any act, omission, misconduct, negligence or any breach of any of the terms and conditions contained herein on your part.

5. LINKS

This site may contain hyperlinks to web sites operated by third parties. The inclusion of hyperlinks to any such web sites does not imply Green Trail Tours 's endorsement of such web sites nor any association with their operators. Green Trail Tours is not responsible for the contents of other web sites. Linking to any hyperlinked web sites is done at your own risk and subject to the specific terms and conditions (if any) of such hyperlinked sites. This Site also may contain advertisements by third parties. Unless otherwise specifically stated on this Site, we do not endorse or make any representation or warranty regarding the liability or quality or accuracy of any products or services featured in, or linked to any advertisements that appears on this Site.

6. AMENDMENTS

Green Trail Tours shall have the right to amend these terms and conditions with or without notice at any time and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use. Such changes shall be effective upon posting of such terms on this site.

7. ADDITIONAL TERMS

Additional terms and conditions may apply to reservations, purchases of travel products and services and other uses of portions of this site. By agreeing with the terms and conditions contained herein, you also agree to abide such additional terms and conditions.

8. REFUNDS AND PENALTIES

In case of  unexpected circumstances which may impact your holiday plans,  we would be glad to assist you with the cancellation procedures and refund your money. The rates of refund are derived from our contractors' requirements, and can be summarized as follows

* According to our booking conditions, you are kindly required to pay a 40% deposit by bank transfer at the time of booking of the trip and settle the remaining of your package value on arrival ( If you pay the balance  master card or credit card there is additional charge of 3% for banking service). or Card Payment authorize Letter and Letter of Approval

Option 1. Western Union Money Transfer - Money in Minutes Confirmation:

To save bank transfer fee (25$US - 50$US), you can send money through Western Union as they offer very competitive commission (2-5%, at least 5$US) and very fast delivery (usually after only 30 minutes). The Western Union form asks your deposit to be delivered to our address or have them call us, please choose the first option. Our address details:

Once your wire has been completed, you will get a 10 digit MCTN (Money Transfer Control Number), please email us and we use this number to pick up the funds from our local Western Union immediately. We need to use an identity card to receive the deposit and you can put down on note area the number 111306656 issued in Ha Tay on the 11^th of April 2001. No other people can receive other than Mr Nguyen Van Dung.

It is your responsibility to ask your bank how much they charge to convert into United States Dollars (USD) and/or transfer fee and if they have to go through a third bank (usually through a bank in U.S.A. like Bank of New York or Bank of America) before Vietcombank. In our travel industry, generally a cancellation fee of 50 or up to 100% cancellation fee is applied if cancellation was made less than a specified number of days. For authentication purposes, only written cancellation notices (e-mail or fax) will be accepted. The refund will be made through bank transfer or through your credit card, depending on the original method of purchase.

9. PARTNER SHIP

The relationship between Green Trail Tours and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other.

10. GOVERNMENT LAW

a. These terms and conditions shall be governed by and construed in accordance with the laws of Vietnam.

b. The parties irrevocably agree that the courts of Vietnam are to have jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions and that, accordingly, any legal action or proceedings arising out of or in connection with this Agreement may be brought in those courts and each of the parties irrevocably and unconditionally submits to the non-exclusive jurisdiction of those courts.

11. ENTIRE AGREEMENT

These terms and conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supercedes any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this site.
